GENERAL TERMS AND CONDITIONS

These general terms and conditions govern the use of the origo-holds.eu online store and the purchase of products via the website. By using the website and placing an order, the buyer confirms that he is familiar with these terms and conditions and agrees to them.

2. Scope and types of buyers

These terms and conditions apply to:

consumers (B2C) – natural persons

business buyers (B2B) – legal entities and sole proprietors

Unless expressly stated otherwise, the provisions apply to both groups of buyers.

2.1 Specifics for B2C and B2B

The right to withdraw from the contract (14 days) applies exclusively to consumers (B2C).

The right of withdrawal does not apply to business customers (B2B), unless otherwise agreed in writing.

3. Products

The subject of sale is climbing holds, macro holds and volumes.

The products are made of:

polyurethane (PU)

thermoplastic (ABS)

Photos and product images are symbolic.

3.1 Technical deviations

Due to the nature of production, minor deviations are possible in:

color shades (RAL, screen effect),

texture,

dimensions and shape.

Such deviations do not constitute a material defect.

4. Prices

All prices are expressed net in EUR (€).

VAT is charged in accordance with applicable legislation.

We reserve the right to change prices without prior notice.

5. Order and conclusion of the contract

The order is placed via the online store.

After placing the order, the buyer will receive a confirmation e-mail.

The purchase contract is concluded with the confirmation of the order.

6. Payments

Payments are made via the Stripe payment system.

Payment is a condition for processing the order.

7. Delivery

Delivery is carried out via the following providers:

up to approx. 100 kg: DPD, GLS

heavier loads: Intereuropa, cargo-partner

Delivery costs are displayed before placing the order.

Delivery times are for information purposes only.

7.1 Transfer of risk

For consumers (B2C): the risk passes upon actual receipt of the goods.

For business customers (B2B): the risk passes upon handing over the goods to the carrier.

8. Right to withdraw from the contract (B2C)

Consumers (B2C) have the right to withdraw from the contract within 14 days.

9. Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

custom-made products,

personalized products,

products with signs of use.

10. Complaints and material defects

The buyer must report the defect within a reasonable time after its discovery.

The claim must contain a description of the defect and evidence (e.g. photographs).

The seller reserves the right to inspect the product and choose a method of solution.

11. Reservation of title

The goods remain the property of the seller until the purchase price is paid in full.

12. Limitation of liability

The products are intended for use on climbing walls and in a controlled environment.

The buyer is responsible for:

proper assembly,

proper use,

regular checking of the condition of the handholds.

The seller is not liable for:

injury to persons,

indirect or consequential damage,

damage due to incorrect use or assembly.

13. Protection of personal data

Personal data is processed in accordance with the Privacy Policy.

14. Out-of-court dispute resolution

The Seller does not recognize any out-of-court dispute resolution provider as mandatory.

The law of the Republic of Slovenia applies.

The competent court in Slovenia has substantive jurisdiction.

16. Changes to the terms and conditions

The Seller reserves the right to change these terms and conditions.
